RE: The tariff classification of various cloths from China.

Dear Mr. Leitner:

In your letter dated October 21, 2005 you requested a classification ruling on behalf of A Plus International.

You submitted three samples. Item #4 is a disposable body cloth and Item # is a disposable facial cloth. Both cloths are made from three layers of man-made fiber non-woven fabric. They contain a water-activated cleanser. The body cloth measures approximately 8.5 x 9 inches and the facial cloth measures 6 x 8 inches. Both cloths feature rounded corners. The body and facial cloth lightly exfoliate the skin while cleansing.

Item #6 is a disposable pouf. It is made from man-made fiber non-woven fabric. The puff also contains water activated moisturizing cleanser. The non-woven fabric is gathered together creating the pouf. A cord is attached to allow the puff to be hung. The disposable puff gently cleanses the skin.

The applicable subheading for the body cloth, face cloth and pouf will be 6302.93.2000, Harmonized Tariff Schedule of the United States (HTS), which provides for bed linen, table linen, toilet linen and kitchen linen: toilet linen and kitchen linen...other: of man-made fibers: other. The rate of duty will be 9.9 percent ad valorem.

The cloths and pouf falls within textile category designation 666. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
