RE: The tariff classification of a man’s swim trunk from Cambodia.

Dear Ms. Iacobello:

In your letter dated September 9, 2005 you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample is a Style 4575069 Men’s Swim Trunk constructed of woven 65% cotton, 35% nylon fabric. The swim trunk features a half elasticized waistband with full waist drawstring tightening, mesh liner, inside pocket, side slash pockets with a mesh lining, front hook and loop closure cargo pocket with two drainage holes, and one rear hook and loop closure patch pocket with a drainage hole. Styles 5216069 and 5216067 are identical except for different printing of the fabric.

The applicable subheading for Styles 4575069, 5216069 and 5216067 Men’s Swim Trunks will be 6211.11.8010, Harmonized Tariff Schedule of the United States (HTS), which provides for “Track suits, ski-suits and swimwear; other garments: Swimwear: Men’s or boys’: Other, Of cotton: Men’s.” The duty rate will be 7.5 percent ad valorem.

Styles 4575069, 5216069 and 5216067 Men’s Swim Trunks fall within textile category designation 359. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
