RE: The tariff classification of a hat from China.

Dear Mr. Simpson:

In your letter dated August 26, 2005, on behalf of Dinteam Industries Ltd., you requested a classification ruling. The sample will be returned to you as requested.

The submitted sample, style 7-50030 is a man’s cap composed of a crown and peak that is woven 70% polyester/30% wool fabric. Between the peak and top and around the hat is knit 100% nylon fabric. The woven portion of the hat imparts the essential character.

The applicable subheading for style will be 6505.90.4090, Harmonized Tariff Schedule of the United States (HTS), which provides for “Hats and other headgear, knitted or crocheted, or made up from lace, felt or other textile fabric, in the piece (but not in strips), whether or not lined or trimmed; hair-nets of any material, whether or not lined or trimmed: Not knitted: Of wool: Other, Other.” The duty rate will be 31 cents per kg +7.9% ad valorem. The textile category designation is 459.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
