RE: The tariff classification of a women’s blouse from India

Dear Ms. Vergona:

In your letter dated August 29, 2005, you requested a tariff classification ruling on behalf of Graham Kandiah LLC. The submitted sample will be returned to you as requested.

The submitted garment designated as style Ischia is a loose fitting women’s blouse constructed from 100 percent cotton woven fabric. The pullover garment is rectangular in shape and covers the body from the shoulders, including the upper arms, to approximately mid-thigh. It is sewn at the side seams from underneath the armholes to the hem allowing the sleeves to drape over the arms and provides full side coverage. The blouse features a V-neckline, openings for the head and arms and a drawstring waist. The neckline is embellished with shells and sequins and the sides and hem have a tasseled trim.

You have stated that the garment is classifiable under subheading 6211.42.0081, HTS, which is a basket provision for women’s garments. The garment has sufficient coverage to be considered a blouse. Accordingly, the applicable subheading for the blouse will be 6206.30.3040, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls’ blouses, shirts and shirt-blouses: of cotton: other: other: other: women’s. The duty rate will be 15.4 percent ad valorem.

The blouse falls within textile category designation 341. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
