RE: The tariff classification of men’s apparel from Sri Lanka and possibly other countries.

Dear Mr. Travis:

In your letter dated August 18, 2005, you requested a classification ruling on behalf of Kellwood Distribution Division for importation by Target Stores. The provided sample will be returned as per your request.

Product ID # 129870 is a men’s underwear boxer short constructed of a translucent woven 100% cotton fabric which you have stated weighs no more than 3.5 ounces per square yard. The boxer will be sold as a 2-unit item either put up on hangers for retail sale or packaged together. The size medium sample has a side length measuring approximately 16 inches. The boxer short features a fabric covered elasticized waistband with a two-button closure at the center of the waist, a one-button fly front, side seams, and a hemmed bottom.

The applicable subheading for Product ID # 129870 will be 6207.11.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for Men's or boys' underpants, briefs, nightshirts, pajamas, bathrobes, dressing gowns and similar articles: underpants and briefs: of cotton. The duty rate will be 6.1 percent ad valorem.
