RE: The tariff classification of an Ipod Carrying Case from China.

Dear Ms. Meintzer:

In your letter dated September 1, 2005, on behalf of Computer Expressions, Inc., you requested a classification ruling for an Ipod Carrying Case.

The sample submitted is not identified by style number. The item is a plush novelty carrying case for an Ipod or similar device. It is wholly of man-made fiber textile materials. The case has a zippered change pocket and is made up to resemble a cat’s face. It measures approximately 5 ½”(H) x 3 ½”(W) x 2”(D). Your sample is being returned as requested.

The applicable subheading for the Ipod Carrying Case will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
