RE: The tariff classification of a woman’s cardigan from China

Dear Ms. Day:

In your letter dated August 31, 2005, you requested a classification ruling on behalf of Western Glove Works. As requested, your sample is being returned to you.

Your sample, style J821286MDW, is a woman’s cardigan constructed from 98% cotton, 2% spandex knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the direction in which the stitches were formed. The garment features a drawstring hood, long sleeves with tubular cuffs, a full front zippered opening, side pockets, and a tubular bottom that does not provide a tightening at the waist.

The applicable subheading for style J821286MDW will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s. The duty rate will be 16.5% ad valorem.
