RE: The tariff classification of modular jack connectors from China and Mexico.

Dear Ms. Wallett:

In your letter dated May 10, 2005 you requested a tariff classification ruling.

The merchandise under consideration is five Modular Jack Connectors. The five connectors are identified as part numbers 74454-0031 (1 Port Enhanced Shielded Mod Jack Connector), 74470-0011 (1 Port Enhanced Special Shield Mod Jack Connector), 74543-0641 (6 Position Shielded Mod Jack Connector), 87180-088 (Low Profile Mod Jack Assembly) and 94927-088 (Low Profile 8 Position Mod Jack, Fully Shielded Connector). Samples of all items were submitted with your ruling request and will be returned to you. From the information provided by you in your ruling request, all five connectors are rated to withstand a maximum of 94V.

As indicated by the submitted samples and literature, the five connectors are single port, RJ45 type female connectors designed to be soldered onto a printed circuit board (PCB).

Part numbers 74454-0031, 74470-0011 and 94927-088 are all 8 position, single port right angle female sockets. Each connector is constructed of a thermoplastic resin housing with copper alloy contacts and soldering post. These three sockets are fully covered with a tin plated copper alloy shielding on all exposed sides, with the exception of the PCB mounting bottom with soldering posts. Part number 87180-088 is an unshielded RJ45 female socket identical in all other aspects to the above three sockets.

Part number 74543-0641 is a single port right angle shielded mod jack female socket identical in all aspects to the above, with the exception of having only 6 position contacts and soldering posts.

The applicable subheading for the five Modular Jack Connectors (Part numbers 74454-0031, 74470-0011, 74543-0641, 87180-088 and 94927-088) will be 8536.69.4040, Harmonized Tariff Schedule of the United States (HTS), which provides for “Electrical apparatus for switching or protecting electrical circuits, or for making connections to or in electrical circuitsfor a voltage not exceeding 1,000 V: Lamp-holders, plugs and sockets: Other: Coaxial connectorsrack and panel connectors; printed circuit connectors; ribbon or flat cable connectors: Printed circuit connectors.” The general rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
