RE: The tariff classification of decorative glass candleholders from China.

Dear Mr. Crago:

In your letter dated March 29, 2005, you requested a tariff classification ruling. Samples are being returned as requested.

The subject merchandise (based on the submitted samples and information) is two sets of three decorative glass candleholders (item number C072MA01246), measuring approximately 8 to 10 inches in overall height, that consist of round-shaped top holders measuring about 2 ¾ inches in depth by 2 ¾ inches across their flared open-top diameter. Each candleholder incorporates a stemmed-shaped stand with a disk-shaped base. One set of candleholders has exterior hand-painted motifs of berries with leaves, while the other set has exterior hand-painted motifs of decorated snowman.

The applicable subheading for these decorative glass candleholders will be 9405.50.4000, Harmonized Tariff Schedule of the United States (HTS), which provides for other non-electrical lamps and lighting fittings, other. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
