RE: The tariff classification of a woman’s blouse from China

Dear Ms. Fox:

In your letter dated February 23, 2005, you requested a classification ruling. The submitted sample will be returned to you as requested.

Style 61-54406 is a woman’s blouse constructed from 100 percent polyester woven fabric. The blouse is sleeveless and features a V-neckline with a ruffle trim that extends down the front of the garment, a standup collar that extends into ties and a ruffled bottom. The blouse measures two inches at the shoulder seams.

The applicable subheading for the blouse will be 6211.43.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for tracksuits, ski-suits and swimwear; other garments: other garments, women’s or girls’: of man-made fibers: blouses, shirts and shirt-blouses, sleeveless tank styles and similar upper body garments excluded from heading 6206. The duty rate will be 16 percent ad valorem..

The blouse falls within textile category designation 641. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
