RE: The tariff classification of two women’s knit garments from Cambodia

Dear Ms. Fontecchio:

In your letter dated February 16, 2005, you requested a classification ruling on behalf of Goody’s Family Clothing, Inc., Knoxville, TN. As requested, your samples are being returned to you.

Your sample, style GDY-1406435, is a woman’s two-piece garment comprised of two women’s upper body garments. The inner garment of this style, the top, is constructed from 60% cotton, 40% modal knit fabric. It features ¼ inch wide shoulder straps and a U-shaped front neckline. The upper back extends straight across from side seam to side seam. The outer garment of this style is constructed from 95% cotton, 5% spandex knit fabric. It extends from the shoulder to the upper back. It features long sleeves and a full front opening with a tie closure. It does not provide sufficient front coverage.

The applicable subheading for the inner garment of style GDY-1406435 will be 6114.20.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: of cotton: tops: women’s. The duty rate will be 10.8% ad valorem.

The applicable subheading for the outer garment of style GDY-1406435 will be 6114.20.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for other garments, knitted or crocheted: other: women’s. The duty rate will be 10.8% ad valorem.

The inner garment of style GDY-1406435 falls within textile category designation 339. The outer garment of style GDY-1406435 falls within textile category designation 359.
