RE: The tariff classification of Christmas holiday clips from China.

Dear Ms. Dias:

In your letter dated January 13, 2005, you requested a classification ruling.

You have submitted photographs depicting item number 2137, Holiday Clips. The clips consist of a set of four different designs. The designs feature a decorated Christmas tree (sample submitted), a Christmas gift, a Candy Cane with a ribbon bow and a Christmas tree ornament. The clips are made of polyresin material and a metal clip is attached to the back. They are fashioned with decorative plastic beads. The clips will be used for decorations on tabletops, napkins, table cloths or on the sides of the plate.

The sample is returned as you requested.

The applicable subheading for set of Christmas holiday clips will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
