RE: The tariff classification of belted trousers for girls’ wear from Indonesia

Dear Ms. Kittel:

In your letter dated January 18, 2005, written on behalf of Target Stores, Import Department TPN-0430, you requested a classification ruling.

Submitted style 120550, manufactured from woven fabric of 97% cotton/3% spandex, is a loosely fitted pair of cuffed trousers. A narrow, ornamented belt of knitted fabric is threaded through the belt loops surrounding the partially elasticized waistband, that fastens together above the zippered, fly-front opening.

As you have requested, the sample garment is being returned.

The applicable subheading for the pair of pants and its accompanying belt will be 6204.62.4050, Harmonized Tariff Schedule of the United States (HTS), which provides for girls’trousersof cotton, other, other, other, trousers, girls’, other, other. The duty rate will be 16.6 percent ad valorem.

This style falls within textile category designation 348. Quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes.
