RE: The tariff classification of two types of travel blankets from China

Dear Ms. Araki:

In your letter dated December 13, 2004 you requested a classification ruling on behalf of It’s All Greek To Me.

You submitted samples of two items referred to as travel blankets. Style 21510 (Green) is a blanket that is made from 100 percent polyester knit fleece fabric. The blanket measures approximately 48 x 54 inches. A 6 x 11 inch flap made from a woven fabric is sewn to one edge of the blanket. The flap has a fabric handle. For storage and travel, the blanket may be folded, rolled and secured with hook and loop fasteners.

Style 21500 (Navy) is made from a laminated fabric. One side consists of a 100 percent acrylic woven fabric and the other is made from a textured polyvinyl chloride (PVC) sheeting material. A thin layer of plastic foam is placed between the fabric and the PVC. This item measures approximately 47 x 53 inches and has a 12 x 7.5 inch flap sewn to one edge. The flap has a fabric handle. For storage and travel, this item is folded multiple times and secured with hook and loop fasteners. This style is not considered a blanket for tariff purposes as it is not primarily for protection against the cold.

The applicable subheading for the Style 21510 travel blanket will be 6301.40.0020, Harmonized Tariff Schedule of the United States (HTS), which provides for blankets and traveling rugs: blankets (other than electric blankets) traveling rugs, of synthetic fibers other. The duty rate will be 8.5 percent ad valorem.

The applicable subheading for the Style 21500 travel blanket will be 6307.90.9889, HTS, which provides for other made up articles, including dress patterns: other: other: other other: other. The duty rate will be 7 percent ad valorem.

The Style 21510 travel blanket falls within textile category designation 666. The Style 21500 travel blanket falls under a subheading that is not assigned a textile category designation.
