RE: The tariff classification of a Chest on Chest from China.

Dear Mr. Derian:

In your letter dated July 29, 2004, you requested a tariff classification ruling.

The merchandise to be imported is identified as a Chest on Chest, No. 22-011-1. The item is made of wood and is inspired by the silhouettes of 19th century English Regency. The chest has an overhanging molding top above a rectangular base with ten drawers.

The applicable subheading for the Chest on Chest will be 9403.50.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Other furniture and parts thereof: Wooden furniture of a kind used in the bedroom: Other: Other, Other.” The rate of duty will be free.

The merchandise in question may be subject to antidumping duties or countervailing duties. This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
