RE: The tariff classification of a radiobroadcasting antenna and parts thereof from Japan.

Dear Mr. Garcia:

In your letter dated March 24, 2004 you requested a tariff classification ruling.

The items in question are denoted as a motorized radiobroadcasting antenna for an automobile, part number MR282622, an automobile antenna base, part number MR979905 and cables for the automobile antenna, part number MB863564.

The motorized radiobroadcasting antenna is designed for use in an automobile. It is composed of the antenna rod, the electric motor, a power relay, a ground cable and a coaxial antenna cable. This is a complete powered vehicle radio antenna that is designed to emerge from a vehicle panel when the radio is activated. This antenna captures the RF broadcast signals and further transmits such signals to the radio for listening of radiobroadcasts.

The antenna base is composed of a plastic base, a coaxial cable and a ground cable. Descriptive literature has been furnished that indicates that this item is specifically designed to house the aforementioned antenna. It provides the mounting surface for the vehicle antenna. It does not have any general use.

The applicable subheading for both the motorized radiobroadcast antenna and mounting base will be 8529.10.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for Parts suitable for use solely or principally with the apparatus of headings 8525 to 8528: Antennas and antenna reflectors of all kinds; parts suitable for use therewith: Other: Other. The duty rate will be 3 percent ad valorem.

Your inquiry does not provide enough information for us to give a classification ruling on the cable for the antenna, part number MB863564. Your request for a classification ruling should include whether the cable is insulated, its conductivity medium and its exact voltage capacity. When this information is available, you may wish to consider resubmission of your request. We are returning any related samples, exhibits, etc. If you decide to resubmit your request, please include all of the material that we have returned to you.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
