RE: The tariff classification of hanging decorations from the Philippines

Dear Ms. Tompkins:

In your letter dated October 13, 2004, you requested a tariff classification ruling.

The submitted sample, identified as Item #3-4560 Tubula, is an approximately 76” x 2” hollow tube (black/beige) that is handwoven from abaca fibers. Both ends feature metal rings to provide shape and there is a metal hanging hook on one end. You indicate that the item is meant to be used in a decorative manner in the home and that it has been suggested that your customers string UL- or CSA-approved lights through the center. The light strings are not included with the item.

You also state that you will also import other versions of the same item, but in different color combinations. They are identified as Item #3-4561 (black/brown) and Item #3-4562 (red/brown).

The applicable subheading for the hanging decorations will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
