RE: The tariff classification of gloves from China.

Dear Mr. Sachs:

In your letter dated September 20, 2004, you requested a tariff classification ruling for three styles of gloves/mittens.

Style #69-661 is a mitten with a sewn-in four-fingered glove liner with a camouflage pattern on the outer surface made of a knit material that you describe as a polyester microfiber. The mitten features a slit across the upper palm that allows the wearer to expose their glove-covered fingers, and can be turned down and magnetically held in place to allow better mobility of the fingers. In addition, a slit in the thumb also allows the wearer’s thumb portion to be turned down and magnetically held in place in order to expose the thumb. You state that this item features Thinsulate Insulation and fleece lining, an embossed rubber-tex overlay at the center of the palm, an elasticized wrist, a backside interior pocket to hold a disposable hand warmer, and a hook and clasp. You state that this item is also available in blaze orange and in camouflage patterns as style numbers 64-661, 65-661, 66-661, and 68-661.

Style #69-695 is a half-fingered glove with a camouflage pattern on the outer surface made of a knit material that you state is polyester microfiber. The glove features a sewn-on mitten style cover of the same camouflage fabric that can be placed over the exposed fingers or secured with a hook and loop fastener when not in use. Additional features include an elasticized wrist and a hook and clasp. You also state that the glove features Thinsulate Insulation, polyfill and fleece lining, a sure grip synthetic palm patch, and a backside interior pocket to hold a disposable hand warmer. You state that this glove is also available in blaze orange and camouflage patterns as styles 64-695, 65-695, 66-695, and 68-695.

Style #25-895-IO is a half-fingered glove made of a blaze orange knit material that you state is polyester fleece. This glove also features a sewn-on mitten style cover of the same fabric that can be placed over the exposed fingers or secured with a hook and loop fastener when not in use. Additional features include an elasticized wrist and a hook and clasp. You state that the glove features DuPont Thermolite Micro and fleece lining and a grain leather palm patch. You state that this glove will also be offered in different camouflage patterns as styles 25-895-HW, 25-895-HWG, 25-895-MO, 25-895-AT, 25-895-BC, and 25-895-SN

We believe that all styles show a design for use in the sport of hunting.

Knitted synthetic fiber sports gloves are provided for under 6116.93.0800, HTS. Therefore, your suggested classification in Chapter 62, HTS, for all styles is not applicable.

The applicable subheading for all styles will be 6116.93.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for gloves, mittens and mitts, knitted or crocheted; other; of synthetic fiber; other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 2.8%.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
