RE: The tariff classification of a sports brassiere from China.

Dear Mr. Santana:

In your letter dated July 1, 2004, you requested a classification ruling on behalf of Basic Resources.

Style BR2100V is a women’s racerback sports brassiere made of a knitted 81% polyester 19% spandex fabric with 2-ply construction at the front and side panels. The brassiere features a heavily elasticized bottom band measuring approximately 1-inch wide that is sewn into the bottom hem, a scoop front neckline, and capping at the arm openings.

The applicable subheading for Style BR2100V will be 6212.10.9020, HTS, which provides for Brassieres, girdles, corsets, braces, suspenders, garters and similar articles and parts thereof, whether or not knitted or crocheted: brassiere: other: other . . . of man-made fibers. The general rate of duty will be 16.9 percent ad valorem.

Style BR2100V falls within textile category designation 649. Based upon international textile trade agreements products of China are subject to quota.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
