RE: The tariff classification of an ice-skating costume from China.

Dear Mr. Del Mundo:

In your letter dated June 14, 2004 you requested a classification ruling. As requested, the sample will be returned to you.

The submitted sample is an item SKU #0276-00725 Ice-Skating Costume constructed of knit 100% velour fabric. The dress is composed of a long sleeve top and panties that are sewn together with a skirt sewn over the panties at the waistline. The panties feature a snap closure crotch. The dress is loose fitting and has poor elasticity and will be worn for “play acting” rather than actual ice-skating. Item SKU #0276-00725 will be imported in girls’ sizes 2-7 years and infants’ sizes 12-18 and 18-24 months.

The applicable subheading for the SKU #0276-00725 Ice-Skating Costume, girls’ sizes 2-7 years, will be 6104.43.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for girls’ other synthetic fiber dresses, knitted or crocheted. The duty rate will be 16% ad valorem.

The applicable subheading for the SKU #0276-00725 Ice-Skating Costume, infants’ sizes 12-18 and 18-24 months, will be 6111.30.5040, Harmonized Tariff Schedule of the United States (HTS), which provides for other synthetic fiber knitted or crocheted babies’ garments. The duty rate will be 16% ad valorem.

The SKU #0276-00725 Ice-Skating Costume, girls’ sizes 2-7 years, falls within textile category designation 636. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The SKU #0276-00725 Ice-Skating Costume, infants’ sizes 12-18 and 18-24 months, are not subject to quota or the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
