RE: The tariff classification of a “Creepy Cloth” from China.

Dear Mr. Williams:

In your letter dated June 8, 2004, you requested a tariff classification ruling.

You submitted photographs of a “Creepy Cloth” identified as style number N0174. The item consists of a cotton cloth that measures approximately 30 inches in width x 4 yards in length. The cloth has holes and tears that suggest a scary torn curtain. The cloth is designed to hang from a doorway, a window, or a ceiling as an eerie home decoration for the Halloween holiday. The cloth will be packaged in a polybag with a hanger.

The applicable subheading for the “Creepy Cloth” identified as style number N0174 will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articles, including magic tricks and practical joke articles; parts and accessories thereof: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
