RE: The tariff classification of a “First Aid Kit Bag” from China.

Dear Ms. Schwartz:

In your letter dated February 21, 2004, on behalf of Work ‘N Leisure Products, Inc., you requested a classification ruling for a “First Aid Kit Bag”.

The sample submitted is identified as a “First Aid Kit Bag”. No style number was submitted. The item is a double handle travel bag specially designed to provide storage, protection, organization and portability to first aid supplies/equipment. It is manufactured with an exterior surface of nylon man-made fiber textile material. The bag is secured by means of a three-sided zippered closure. In its unzipped position the bag is designed to lay flat featuring various interior pockets/compartments designed to contain first aid supplies. The bag measures approximately 12”(W) x 8 ¼”(H) x 2”(D). The interior and exterior surface areas are printed with the words “American Red Cross” and the “Basic Principles of First Aid”.

You suggest classification for the first aid kit bag under subheading 3006.50.0000, HTSUSA, as first aid boxes or kits. Heading 3006 does not include empty first aid kit containers. Subheading 3006.50.0000 is not applicable. However, the first aid kit bag is of a kind provided for in HTS 4202, and is more specifically provided for in heading 4202.92.9026, HTSUSA, which provides in part, for other bags and containers.

The applicable subheading for the first aid kit bag will be 4202.92.9026, Harmonized Tariff Schedule of the United States (HTS), which provides in part, for other bags and containers, with outer surface of textile materials, other, other, other, of man-made fibers. The duty rate will be 17.6 percent ad valorem.

HTS 4202.92.9026 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
