RE: The tariff classification of men’s pajamas from China

Dear Ms. Greener:

In your letter dated January 9, 2004, you requested a classification ruling.

You submitted men’s pajamas which will be returned as you have requested. The sample was identified as item 015-0458 and is representative of garments which will be imported under that style number for regular sizes and under item number 015-0459 for tall sizes.

The pajamas are made of 100% woven cotton chambray fabric. The top features a left over right opening secured shut with four buttons; a patch pocket over the left chest; a spread collar with rounded edges, long sleeves with deep hems; and a straight hemmed bottom. The pajama pants feature an elasticized waistband with a drawtape threaded through it; a font fly secured with one snap; two side seam pockets; and hemmed leg openings. You state that these pajamas will be imported packed in a polyurethane bag and sold as a unit in your catalogs.

The applicable subheading for styles 015-0458 and 015-0459 will be 6207.21.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for men’s or boys’ nightshirts or pajamas: Of cotton: With two or more colors in the warp and/or the filling: Men’s. The duty rate will be 8.9% ad valorem.

Styles 015-0458 and 015-0459 fall within textile category designation 351. Based upon international textile trade agreements products of China are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
