RE: The tariff classification of steel fittings from China.

Dear Mr. Waite:

In your letter dated January 14, 2003 on behalf of Trident, a Division of Anderson Copper and Brass Company (“Trident”), you requested a tariff classification ruling. Descriptive literature and representative samples were submitted with your request.

The products to be imported are forged and unforged nonalloy steel threaded hydraulic fittings used with hydraulic hoses that are composed of multiple materials. These hydraulic fittings come in various shapes/forms such as elbows, crosses, tees, plugs, straight connectors, couplings, etc. You state that they are used in a variety of industrial applications, including forklifts and other surface vehicles.

The applicable subheading for the nonalloy steel hydraulic hose fittings will be 7326.90.8587, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of iron or steel, other, other, other, other, other. The rate of duty will be 2.9 percent ad valorem.

It should be noted that in HQ 562095 dated July 3, 2002, it was held that certain fittings that were designed as connectors for both tubing and hose are classifiable as tube or pipe fittings of iron or steel in HTS heading 7307.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
