RE: The tariff classification of fringes from China

Dear Ms. Krupskas:

In your letter dated January 15, 2004, you requested a tariff classification ruling. The ruling request is on behalf of Horizon Fabrics.

The first sample submitted, identified as Item #CBYH13306-79, is referred to as a chenille fiber fringe that is constructed of a knit yarn and a chenille-like “eyelash yarn” and is, in toto, 50 percent rayon and 50 percent polyester. It is approximately 2¼” wide.

Of similar construction are the following: CBYH13311-43 is not identified in your letter, but we identified it by the process of elimination. It is described as 100% rayon, 1-3/4” wide. CBYH13312-63, referred to as a funky fiber fringe, is constructed of 100 percent rayon and is 2½” wide.

All three of these items appear to be manufactured by running a length of yarn or yarns back and forth across a knitting machine or loom and stitching both edges while also running two rows of stitching down the middle; the yarns are cut between these two middle rows, creating two lengths of loose yarns held at both edges.

CBYH13308-29, called chenille loop, is100% polyester and is 1½” wide. Its construction is similar, but the yarns are not stitched or cut in the middle, so it is looped and stitched at both edges.

The applicable subheading for items CBYH13306-79, CBYH13311-43, CBYH13312-63, and CBYH13308-29 will be 5609.00.3000, Harmonized Tariff Schedule of the United States (HTS), which provides for articles of yarn, . . . twine, cordage, rope or cables, not elsewhere specified or included: Of man-made fibers. The rate of duty will be 4.5 percent ad valorem.

The next item is identified in your letter as Item #CBYH13316-66 but the sample is identified as CBYH13316-96. It is a pompom fringe, with 1” pompoms (diameter) hanging from a 1” knit band, 1” apart. It is constructed of 100 percent rayon and is approximately 2½” wide.

The applicable subheading for CBYH13316-66 or -96 will be 6307.90.9889, HTS, which provides for other made up textile articles, other. The rate of duty will be 7 percent ad valorem.

CBYH13305-107 is a beaded tassel fringe. The tassels, each with one plastic bead, are suspended from a ¾” woven band. The width of the entire item is 2¾”.

The applicable subheading for CBYH13305-107 will be 5808.90.010, HTS, which provides for pompoms and similar articles, of cotton or man-made fibers. The rate of duty will be 3.9 percent ad valorem.

In the future, please limit your requests to five (5) items or fewer.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
