RE: The tariff classification of taps from Germany

Dear Ms. Vybiral:

In your letter dated October 3, 2003 you requested a tariff classification ruling.

The taps will be used in multispindle automatic machine tools to produce internal threads (taps). The taps are inserted into a bushing or tap holder which is held in place by a heavy tapping attachment. This attachment in turn is attached to the multispindle machine tool. By feeding the tap into a pre-drilled hole, internal threads are created in the part being manufactured. The taps in question will be used to produce an “RP Thread” designation which is a British Straight Pipe Thread (European Designation). Taps are made from tool steel and are ½” or ¾” in size.

The applicable subheading for the taps will be 8207.40.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Interchangeable tools for handtools, whether or not power-operated, or for machine-tools (for example, for pressing, stamping, punching, tapping, threading, drilling, boring, broaching, milling, turning or screwdriving), including dies for drawing or extruding metal, and rock drilling or earth boring tools; base metal parts thereof: Tools for tapping or threading, and parts thereof: Other. The rate of duty will be 4.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
