RE: The tariff classification of spring pins and spring bushings from Switzerland.

Dear Ms. Easton:

In your letter dated August 2, 2003, on behalf of your client Connex Inc., Erie, PA, you requested a tariff classification ruling.

The submitted catalogs have described your items as follows:

● Spring pins - used for fastening. They come in various dimensions and are made of alloyed steel (AISI 6150 chrome vanadium spring steel or AISI 301 stainless steel). They are longitudinally slotted with a staggered-tooth seam.

● Spring bushings - which come in various sizes, are for use in various industries e.g. farming, construction, mining, and forestry. They are made of AISI 6150 high grade spring steel. They produce a high surface bearing pressure against the housing wall.

The applicable subheading for the spring pins will be 7318.29.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for screws, bolts, nuts, coach screws, screw hooks, rivets, cotters, cotter pins, washers (including spring washers) and similar articles, of iron or steel: non-threaded articles: other. The duty rate will be 2.8% ad valorem.

The applicable subheading for the spring bushings will be 8483.30.8090, HTS, which provides for plain shaft bearings: other: plain shaft bearings: without housing: other. The rate of duty will be 4.5% ad valorem.

Consideration was given to classifying the spring bushings in subheading 7318.29.0000, HTS, as you have suggested. However, that classification was deemed inappropriate as it does not perform the function of a fastener.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
