RE: The tariff classification of “Beach Pockets” from China.

Dear Ms. Bigford:

In your letter dated June 25, 2003 you requested a tariff classification ruling. This office was provided with illustrative literature of the product.

The item is called a Beach Pocket. The item is composed of a 2½ inch ABS plastic barrel that slides onto a beach umbrella pole; attached to the barrel are three pockets/pouches, measuring approximately 10 inches x 9 inches, made of 100% nylon fabric. The advertising literature states “Stops Beach Umbrellas from Blowing Away” and “Just Fill with Sand.” Below in the bottom third of the literature is the statement “Stores Personnel Belonging Too.”

The item is primarily used for weighing down a beach umbrella and acts as an umbrella base. The item is an accessory to an umbrella. Umbrellas are classified under heading 6601 HTS.

The applicable subheading for the Beach Pocket will be 6603.90.8000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Parts, trimmings and accessories of articles of heading 6601 or 6602: Other: Other.” The rate of duty will be 5.2 percent ad valorem.

The Beach Pocket is not subject to quota or the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
