RE: The tariff classification of a woman’s coat from Hong Kong

Dear Mr. Imbrogulio:

In your letters dated May 27, 2003 and June 18, 2003, you requested a classification ruling.

The sample submitted, style number W834DT121S, is a woman’s thigh-length coat. The coat is constructed of a shell composed of a woven 100% wool fabric with a visible polyurethane coating on the inner surface and a lining composed of a woven man-made fiber fabric, which are quilted together in a diamond pattern with a nonwoven batting fill in between.

The coat has a fold-down pointed collar and a full front opening secured by a double pull zipper closure. An overlapping flap with five button closures covers the zipper area. The garment has long sleeves with a capping fabric at the wrist area, two front patch pockets with flaps below the waist and a straight cut bottom hem with a capping fabric at the edge. There is a textile label that features the “Faconnable” tradename above the left front pocket.

The sample is being returned to you as you have requested.

Based on the production sequence, in which the shell fabric is quilted and then cut into components, classification in HTS 6210 is precluded.

The applicable subheading for the coat will be 6202.11.0010, Harmonized Tariff Schedule of the United States (HTS), which provides for women’s overcoats, carcoats, capes, cloaks and similar coats: of wool or fine animal hair. The duty rate will be 41.5¢/kg + 16.8 percent ad valorem.

The coat falls within textile category designation 435. Based upon international textile trade agreements products of Hong Kong are presently subject to quota restraints and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the Textile Status Report for Absolute Quotas, which is available at our Web site at www.cbp.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
