RE: The tariff classification of a duffel bag on wheels from China.

Dear Ms. Santos:

In your letter dated April 14, 2003, you requested a classification ruling for a duffel bag on wheels.

The sample submitted is identified as CVS item number 233815 “Super Roll-A-Ton”. The item is a 29” rolling duffel bag designed to provide storage, protection and portability for clothing and other personal effects. It is manufactured with an exterior surface of polyester man-made fiber textile material. The bag features one large main zippered compartment with additional pockets for storage on the bag’s front exterior surface area. The bag is designed to be carried by means of top and side padded carrying handles and/or pulled by means of a telescopic handle and in-line skate wheels. Your sample is being returned as requested.

The applicable subheading for item 233815 will be 4202.92.3031, Harmonized Tariff Schedule of the United States (HTS), which provides for travel, sports and similar bags, with outer surface of textile materials, other, of man-made fibers, other. The duty rate will be 17.8 percent ad valorem.

HTS 4202.92.3031 falls within textile category designation 670. Based upon international textile trade agreements products of China are not currently subject to quota and the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
