RE: The tariff classification of men’s knit garments from Bangladesh, Myanmar / Burma, Cambodia, China, Hong Kong, Korea, Macau and Vietnam.

Dear Ms. Scott:

In your letter dated December 5, 2002, you requested a tariff classification ruling on behalf of Sanmar Corporation. As requested, your samples will be returned.

Style F251 is a men’s sweatshirt constructed from 60 percent cotton, 40 percent polyester, finely knit fabric that is napped on the inside surface. Style F251 features a rib knit crew neckline; a small triangular rib knit insert at the front neckline; a half-moon at the rear neckline; long sleeves with rib knit cuffs; a woven fabric label sewn into the left side seam; and a snug fitting rib knit bottom.

Style F255 is a men’s sweatshirt constructed from 60 percent cotton, 40 percent polyester, finely knit fabric that is napped on the inside surface. Style F255 features a self-fabric hood with a drawstring; a half-moon at the rear neckline; long sleeves with rib knit cuffs; self-fabric contrast color inserts on each sleeve; side seam pockets below the waist; a woven fabric label sewn into the left side seam; and a snug fitting rib knit bottom.

Style F290 is a men’s pullover garment constructed from 78 percent cotton, 22 percent polyester, finely knit fabric that is napped on the inside surface and brushed or sueded on the outside surface. Style F290 features a rib knit crew neckline; a self-fabric triangular insert at the front neckline; long sleeves with rib knit cuffs; and a snug fitting rib knit bottom.

Style F208 is a men’s pullover garment constructed from 67 percent cotton, 33 percent polyester, double knit fabric that measures 13 stitches per two centimeters counted horizontally on the outside surface of the fabric. Style F208 features a rib knit V-neckline; long, raglan sleeves with rib knit cuffs; and a straight, hemmed bottom with side slits.

Style K321 is a men’s pullover garment constructed from 100 percent cotton, finely knit interlock fabric that measures 30 stitches per two centimeters counted in the horizontal direction. Style K321 features a rib knit mock turtle neckline; long sleeves with rib knit cuffs; and a straight, hemmed bottom with side slits.

The applicable subheading for Styles F251 and F255 will be 6110.20.2040, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: sweatshirts: men's or boys'. The rate of duty is 17.3 percent ad valorem. Effective January 1, 2003, the rate of duty will be 16.9 percent ad valorem.

The applicable subheading for Styles F290, F208, and K321 will be 6110.20.2065, Harmonized Tariff Schedule of the United States, (HTS), which provides for: sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: men's or boys'. The rate of duty is 17.3 percent ad valorem. Effective January 1, 2003, the rate of duty will be 16.9 percent ad valorem.

Styles F251, F255, F290, F208 and K321 fall within textile category designation 338. Based upon international textile trade agreements, products of Bangladesh, China, Cambodia, Hong Kong, Korea, and Macau are subject to visa requirements and quota restraints. Products of Myanmar / Burma and Vietnam are not presently subject to visa requirements or quota restraints.

For your information, merchandise from Myanmar / Burma must be marked for country of origin purposes with the names “Burma”, “Myanmar / Burma”, or “Burma / Myanmar” to satisfy the requirements of 19 U.S.C. 1304. Imported goods that are marked with “Myanmar” alone do not meet the country of origin requirements.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
