RE: The tariff classification of Bluetooth Cards and adapters from Taiwan.

Dear Mr. Kwong:

In your letter dated October 3, 2002 you requested, a tariff classification ruling.

The samples you have submitted, Bluetooth PDA Adapter Card (Model # F8T020), Bluetooth PC Card (Model# F8T002 and Bluetooth USB Adapter (Model # F8T001) are transmitters which provide simultaneous reception and transmission between PDA, Laptop computers, and desktop computers with USB ports and other devices such as computers, printers, and mobile phones without the use of cables.

Based on the information provided and your answers to questions asked in the rejection letter there appears to be no clear principal function for these items in Chapter 84 of the Harmonized Tariff Schedule.

The applicable subheading for the Bluetooth PDA Adapter Card (Model # F8T020), Bluetooth PC Card (Model# F8T002 and Bluetooth USB Adapter (Model # F8T001) will be 8525.20.9080, Harmonized Tariff Schedule of the United States (HTS), which provides for Transmission apparatus for radiotelephony, radiotelegraphy, radiobroadcasting or television, whether or not incorporating reception apparatus or sound recording or reproducing apparatus; television cameras; still image video cameras or other video camera recorders; digital cameras: Transmission apparatus incorporating reception apparatus: Other Other. The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
