RE: The tariff classification of a flatware and cutlery set from China

Dear Ms. Woodward:

In your letter dated September 30, 2002, you requested a tariff classification ruling.

The merchandise is the Oneida Color Trends Double Set, a stainless steel flatware and cutlery service for six. The flatware portion of the set consists of 6 salad forks, 6 place forks, 6 place knives, 6 place spoons, 6 teaspoons, 1 serving spoon, and 1 serving fork stored in a chrome-plated steel caddy. All flatware pieces have plastic handles. The cutlery part of the set is composed of 6 steak knives with wooden handles stored in a wooden block. The applicable subheading for the Oneida Color Trends Double Set will be 8215.20.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for spoons, forks, ladlesand similar kitchen or tableware, other sets of assorted articles. The general rate of duty will be the rate of duty applicable to that article in the set subject to the highest rate of duty. According to the values you provided, that will be heading 8211.91.5060, HTS, which provides for knives with rubber or plastic handles, other. The rate of duty will be 0.7 cents each (on every piece in the set) plus 3.7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
