RE: The tariff classification of o-Chlorobenzoyl chloride, CAS # 609-65-4, imported in bulk form, from Japan

Dear Mr. Chivini:

In your letter dated August 9,2002, you requested a tariff classification ruling.

The subject product, o-Chlorobenzoyl chloride, is a halogenated aromatic monocarboxylic acid indicated for use as a pharmaceutical intermediate.

The applicable subheading for o-Chlorobenzoyl chloride, also known as 2-Chlorobenzoyl chloride, will be 2916.39.7500, Harmonized Tariff Schedule of the United States (HTS), which provides for Aromatic monocarboxylic acid, their anhydrides, halides, peroxides, peroxyacids and their derivatives: Other: Other: Other: Other. The rate of duty will be 0.7 cents per kilogram plus 8.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
