RE: The tariff classification of two textile sewing baskets, from China.

Dear Mr. Awana:

In your letter dated August 9, 2002, on behalf of Prima Creations, Inc., Yorba Linda, CA, you requested a tariff classification ruling.

Two representative samples were submitted which were identified as items E30139 and E30141.

Style E30139 is a sewing basket composed of a frame of paperboard. The exterior and interior portions of this paperboard are covered with man-made fiber woven textile fabrics. There is an open pocket with an elasticized top and a pin cushion attached to the under portion of the lid. Finally, a textile covered plastic handle is attached for carrying and a Velcro-like latch-type closure secures the lid.

Style E30141 is a sewing basket also composed of a frame of paperboard. The attached lid exterior is covered with a man-made fiber woven textile fabric. The central compartment exterior is covered with twisted strips of plastic which are considered textile under the Harmonized Tariff Schedules of the United States. The twisted strips are woven between plastic strips. The interior is lined with a man-made woven fabric. There is an open pocket with an elasticized top and a pin cushion attached to the under portion of the lid. The basket is carried by a textile covered plastic handle and secured by a plastic latch-type closure.

The applicable subheading for the two baskets will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up article...Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
