RE: The tariff classification of notebook binders, from China.

Dear Mr. Krueger:

In your letters dated June 24th, 2002 and August 5th, 2002, you requested a tariff classification ruling.

The instant sample, as described in your letter, consists of a notebook binder made of a plastic base covered with a nylon woven fabric. In its open position, the left side features a flap attached on the left and bottom edges. On the bottom of the flap is an open-work knit mesh pocket with a zipper closure. Above this pocket are three open sleeves for pens and a pocket with a hook-and-loop closure. The right side has a vertical pocket with an open pocket. Inserted into the vertical pocket is a removable plastic sheet with three metal loose-leaf rings attached to a metal base. The binder is held closed by a zipper which goes around three sides of the binder. A 1 1/2" horizontal woven strip is attached to the exterior of the binder. In its closed position, the binder measures approximately 14 inches by 11 inches. Your further indicate that these binders will be imported under the following three item codes:

ZBIND15 will have 1 ½-inch rings on the plastic insert (15 designating 1.5 inch rings). ZBIND2 will have 2-inch rings on the plastic insert (2 designating 2 inch rings). ZBINDMT will not have the insert or rings (MT designating Empty).

Please note that with respect to item ZBINDMT, we will not be able to provide a binding ruling without a representative sample.

The applicable subheading for the binders (ZBIND15 and ZBIND2) will be 6307.90.9889, Harmonized Tariff Schedule of the United States (HTS), which provides for other made up article...Other. The rate of duty will be 7 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
