RE: The tariff classification of two women’s sweaters from Indonesia and Macau and two pullovers from Macau and China

Dear Ms. Whitehead:

In your letter dated July 16, 2002, you requested a classification ruling. As requested, your samples are being returned to you.

Your sample, style ZJ2NB8695, is a woman’s sweater constructed from 100% cotton 2x2 ribbed knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The garment features a V-neckline with three button closures and long sleeves. The country of origin is Indonesia.

Style HD1VV8115 is a woman’s sweater constructed from 91% cotton, 4% lambs wool, 4% angora, 1% nylon 6x4 ribbed knit fabric. The outer surface of the garment measures nine or fewer stitches per two centimeters in the horizontal direction. The garment features a 1x1 ribbed knit mock collar, long sleeves finished with jersey knit cuffs and a three-inch jersey knit tubular bottom. The country of origin is Macau.

Style HJ2ND8709 is a woman’s a pullover constructed from 100% cotton jersey knit fabric. The outer surface of the garment measures more than nine stitches per two centimeters in the horizontal direction. The garment features a round neckline, long 2x2 ribbed knit sleeves, a four inch 2x2 ribbed knit bottom and two ten inch side slits extending from the armhole to the bottom of the pullover which is secured with 6 six buttons. The country of origin is Macau.

Style ZJ2KG8678 is a woman’s pullover constructed from two fabrics. The front panel is constructed from 60% cotton, 40% acrylic 2x2 ribbed knit fabric. The back panel is constructed from 60% cotton, 40% acrylic jersey knit fabric. The outer surface of both panels measure more than nine stitches per two centimeters in the horizontal direction. The garment features a square neckline and 2x2 ribbed knit cap sleeves. The country of origin is China.

The applicable subheading for the sweaters will be 6110.20.2020, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: sweaters: women’s. The duty rate will be 17.3% ad valorem.

The applicable subheading for the pullovers will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of cotton: other: other: other: women’s. The duty rate will be 17.3% ad valorem.

The sweaters fall with within textile category designation 345. The pullovers fall within textile category designation 339. Based upon international textile trade agreements products of China, Indonesia and Macau are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
