RE: The tariff classification of a decorative sign with the words “Season’s Greetings”, style 280348, from China.

Dear Ms. Wilson:

In your letter dated June 7, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on a decorative hanging sign (style 280348), that spells out the words “Seasons Greetings” (for the Christmas season) framed with deer antlers. The sign is made of 99 % polyresin (40 % calcium carbonate derived from natural stone and 59 % unsaturated polyester) and 1 % PVC. The decorative sign has a leather loop on top for hanging the decoration. The decorative sign will be classified in Chapter 95 of the HTSUSA as a Christmas ornament. The sample will be returned, as requested.

The applicable subheading for the “Season’s Greetings” decorative hanging sign, style 280348, will be 9505.10.2500, Harmonized Tariff Schedule of the United States (HTS), which provides for “Festive, carnival or other entertainment articlesparts and accessories thereof: Articles for Christmas festivities and parts and accessories thereof: Christmas ornaments: Other: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
