RE: The tariff classification of a “Snowflake Baby” from China.

Dear Ms. Aldinger:

In your letter dated June 21, 2002, you requested a tariff classification ruling.

The submitted sample, Item #928838, “Snowflake Baby”, is a hard plastic doll that is not stuffed and measures approximately 13 inches in height. The doll is dressed in a white snowsuit of polyester and plush fabric decorated with silver glitter. The doll’s hands are covered with white mittens and her head is covered by a snowflake shaped hood with a white fur interior. Squeezing the doll’s stomach activates a small music box that plays the song, Let It Snow.

The applicable subheading for Item #928838, “Snowflake Baby”, will be 9502.10.0060, Harmonized Tariff Schedule of the United States (HTS), which provides for Dolls representing only human beings and parts and accessories thereof: Dolls, whether or not dressedOther. The rate of duty will be free.

The “Polar Bear Toy” will be addressed under separate cover in NY Ruling #I83403.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
