RE: The tariff classification of flat-rolled steel from Germany.

Dear Mr. Bialek:

In your letter dated May 21, 2002, you requested a tariff classification ruling.

The product to be imported is cold-rolled through-hardened alloy steel sheet in cut lengths. The sheets will range from 1 mm to 4 mm in thickness. These sheets will be ultimately used in the manufacture of circular saw bodies. Your product designated S264-620-2480A measures 620 mm in width and 2.64 mm in thickness. Product number S244-312-2496A measures 312 mm in width and 2.44 mm in thickness. Product number S204-260-2340A measures 260 mm in width and 2.04 mm in thickness.

The applicable subheading for the cold-rolled alloy steel sheet designated S264-620-2480A will be 7225.50.8085, Harmonized Tariff Schedule of the United States (HTS), which provides for flat-rolled products of other alloy steel, of a width of 600 mm or more, other, not further worked than cold-rolled (cold-reduced), other, of a thickness of less than 4.75 mm, other, other, other. The rate of duty will be 0.8 percent ad valorem.

The applicable subheading for the cold-rolled alloy steel sheet designated S244-312-2496A will be 7226.92.5000, HTS, which provides for flat-rolled products of other alloy steel, of a width of less than 600 mm, other, not further worked than cold-rolled (cold-reduced), other, of a width of 300 mm or more. The rate of duty will be 0.8 percent ad valorem.

The applicable subheading for the cold-rolled alloy steel sheet designated S204-260-2340A will be 7226.92.8050, HTS, which provides for flat-rolled products of other alloy steel, of a width of less than 600 mm, other, not further worked than cold-rolled (cold-reduced), other, of a width of less than 300 mm, of a thickness exceeding 0.25 mm, other. The rate of duty will be 1.2 percent ad valorem.

On March 5, 2002, President Bush proclaimed additional tariffs and quotas on a number of steel mill products for a period of three years. Products classified under HTS subheadings 7225.50.8085, 7226.92.5000 and 7226.92.8050, unless specifically excluded, are subject to additional duties. See subheadings 9903.72.85 through 9903.73.04, copy attached. Based upon the description of the merchandise provided in your request, the applicable Chapter 99 subheading is 9903.73.02 which currently carries an additional 30 percent ad valorem tariff. At the time of importation, you must report this Chapter 99 number in addition to the Chapter 72 number listed above.

The Proclamation is subject to periodic amendment of the exclusions, and the additional tariffs are reduced in the second and third years of the program, so you should exercise reasonable care in monitoring the status of goods covered by the Proclamation.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
