RE: The tariff classification of a Road Tennis game from Taiwan.

Dear Mr. Brisbois:

In your letter dated June 5, 2002, you requested a tariff classification ruling, on behalf of American Racket Co., your client.

You are requesting the tariff classification on an item that has been described as a Road Tennis game, no style number has been indicated. The Road Tennis game is sold as a complete game/set. The game consists of the following components: two wooden or graphite rackets, two plastic support posts and bases, two road tennis balls, one road tennis net made of canvas material, one carrying case used for the sole purpose of packaging the game and one set of gaming instructions with chalk. The Road Tennis game is classified in Chapter 95 of the HTSUSA as other outdoor games, and the bag is considered GRI 5(a) packing and is dutiable with its contents.

The applicable subheading for the Road Tennis game will be 9506.99.6080, Harmonized Tariff Schedule of the United States (HTS), which provides for “Articles and equipment for general physical exercise, gymnastics, athletics, other sportsor outdoor gamesparts and accessories thereof: Other: OtherOther.” The rate of duty will be 4 % ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
