RE: The tariff classification of “Monster Novelty Items”, item # 189970, from China.

Dear Ms. Santos:

In your letter dated May 21, 2002, you requested a tariff classification ruling.

You are requesting the tariff classification on a product that is described as “Monster Novelty Items”, item number 189970. The items are small plastic monsters attached to a plastic clip. The monsters are available in assorted colors and styles. The plastic clip enables the plastic monsters to be attached to a backpack, belt loop, or a jacket, etc. The plastic monsters, attached to plastic clips will be classified in Chapter 95 of the HTSUSA, as other toys representing non-human creatures, such as monsters. The samples will be returned, as requested.

The applicable subheading for the “Monster Novelty Items”, item number 189970, will be 9503.49.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for “Toys representing animals or non-human creatures (for example, robots and monsters) and parts and accessories thereof: Other.” The rate of duty will be free.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
