RE: The tariff classification of gloves from Indonesia.

Dear Ms. Miller:

In your letter dated May 15, 2002, you requested a tariff classification ruling. The samples will be returned as per your request.

Four samples were received. Style GF0017 is a synthetic leather glove with a tacky rubber coating that extends from fingertip to wrist on the palmside. The glove features fourchettes, slit vents on the backside fingers and a heavily elasticized wristband with a side vent secured with a hook and loop tab closure. The rubber coated non-woven synthetic palmside material imparts the essential character of this football glove. .
Style GF0020 has a goatskin leather palmside with a knit spandex back of the hand. The glove features a nylon fabric covered neoprene insert across the back of the knuckles, fourchettes and a heavily elasticized wristband with a side vent secured with a hook and loop tab closure. The leather palmside material imparts the essential character of this football glove.

Style GS0054 is a knit spandex glove with latex foam overlays on the palm and palmside tips of the fingers and thumb. The glove features fourchettes and a heavily elasticized wristband with a side vent secured with a hook and loop fabric tab closure. The knit material imparts the essential character of this field player’s soccer glove.

Style GS0076 has a complete palmside constructed of a four-ply material consisting of two cellular plastic coated knit fabrics that are bonded together. The knit backside of this soccer goalie glove is covered with PVC foam overlay. Additionally, the glove features a substantial wrist strap with a PVC foam tab closure secured with hook and loop fabric. The “Nike Swoosh” design trademark is displayed on the wrist closure.

The applicable subheading for Style GS0054 will be 6116.93.0800, Harmonized Tariff Schedule of the United States (HTS), which provides for Gloves, mittens and mitts, knitted or crocheted: other: of synthetic fibers: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.3 percent ad valorem.

The applicable subheading for Style GS0076, will be 6116.10.0800, HTS, which provides for Gloves, mittens and mitts, knitted or crocheted: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 3.3 percent ad valorem.

The applicable subheading for Style GF0017, will be 6216.00.0800, HTS, which provides for Gloves, mittens and mitts: impregnated, coated or covered with plastics or rubber: other gloves, mittens and mitts, all the foregoing specially designed for use in sports, including ski and snowmobile gloves, mittens and mitts. The rate of duty will be 1.7 percent ad valorem.

The applicable subheading for style GF0020 will be 4203.21.8060, HTS, which provides for Articles of apparel and clothing accessories, of leather or of composition leather: Gloves, mittens and mitts: Specially designed for use in sports: Other . . . Other. The rate of duty will be 4.9 percent ad valorem.

Articles classifiable under subheadings 4203.21.8060, 6116.93.0800 and 6216.10.0800, HTS, that are products of Indonesia, are currently entitled to duty free treatment under the Generalized System of Preferences (GSP) upon compliance with all applicable regulations. The GSP, however, is subject to modification and periodic suspension, which may affect the status of your transaction at the time of entry for consumption or withdrawal from warehouse. To obtain current information on GSP, check the Customs Web site at www.customs.gov. At the Web site, click on "CEBB" and then search for the term "GSP".

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
