RE: The tariff classification of leno woven fiberglass self-adhesive joint tape and leno woven fiberglass fabric scrim from China.

Dear Mr. Schlecht:

In your letter dated January 20, 2002 you requested a tariff classification ruling.

A sample of the self-adhesive woven fiberglass tape and descriptive literature describing the leno woven fiberglass fabrics accompanied your request for a ruling. The submitted leno woven narrow fabric, designated as “Fiberglass Self-adhesive Mesh Tape” style CG53-9X9, is composed of 100% glass fiber and is uncolored It contains 3.5 warp ends per centimeter and 8.5 filling picks per centimeter. Weighing approximately 53 g/m2, it will be imported in 5 centimeter widths. This open-work leno product has been coated with an adhesive which represents approximately 25% of its weight. Your correspondence indicates that this product will be used in the construction industry as drywall joint tape.

Descriptive literature supplied indicates that the products, designated as styles CAG57-6X5, CAP60-20X10, CAG65-5X5, CAG70-5X5, CAG70-8X8, CAG80-6X5, CAG85-8X8, CAG90-8X6, CAG90-6X6, CAG128-5X5, CAG128-2.5X2.5, CAG 143-5X5, CAG143-2.5X2.5 and CAG173-5X4, are all leno woven fabric made from glass fiber. The first number in each style is the weight in grams per square meter of that particular style while the second group of numbers for each style codes for the number of warp ends and filling picks per millimeter. Each of these fabrics is coated with an acrylic copolymer and is characterized by an open-work mesh construction. The plastic coating represents approximately 18% of the total weight of each of the products. Each of the fabrics will be imported in widths exceeding 30 centimeters and will be imported both colored and uncolored. These products will be used in the construction industry as a reinforcement scrim for cement , plastics, pitch, wall materials and roofing. The essential character of these materials is imparted by the fiberglass.

The applicable subheading for the self-adhesive fiberglass tape style CG53-9X9 will be 7019.51.9010, Harmonized Tariff Schedule of the United States (HTS), which provides for glass fibers (including glass wool) and articles thereof (for example, yarn, woven fabrics)other woven fabrics, of a width not exceeding 30 centimeters, other, weighing 185 grams or less per square meter. The rate of duty will be 6 percent ad valorem.

The applicable subheading for all the wide width fiberglass fabrics designated as styles CAG57-6X5, CAP60-20X10, CAG65-5X5, CAG70-5X5, CAG70-8X8, CAG80-6X5, CAG85-8X8, CAG90-8X6, CAG90-6X6, CAG128-5X5, CAG128-2.5X2.5, CAG 143-5X5, CAG143-2.5X2.5 and CAG173-5X4 which are imported uncolored will be 7019.59.4010, Harmonized Tariff Schedule of the United States (HTS), which provides for glass fibers (including glass wool) and articles thereof (for example, yarn, woven fabrics), other woven fabrics, other, not colored, other, weighing 185 grams or less per square meter. The rate of duty will be 7.5 percent ad valorem.

The applicable subheading for all the wide width fiberglass fabrics designated as styles CAG57-6X5, CAP60-20X10, CAG65-5X5, CAG70-5X5, CAG70-8X8, CAG80-6X5, CAG85-8X8, CAG90-8X6, CAG90-6X6, CAG128-5X5, CAG128-2.5X2.5, CAG 143-5X5, CAG143-2.5X2.5 and CAG173-5X4 which are imported colored will be 7019.59.9010, Harmonized Tariff Schedule of the United States (HTS), which provides for glass fibers (including glass wool) and articles thereof (for example, yarn, woven fabrics), other woven fabrics, other, colored, other, weighing 185 grams or less per square meter. The rate of duty will be 7.8 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
