RE: The tariff classification of a shortalls set for girls’ wear from Bangladesh

Dear Ms. Bauman:

In your letter dated February 5, 2002, written on behalf of Star Ride Kids Inc., you requested a classification ruling.

Submitted style 50101/4 is comprised of two garments. One of these garments, manufactured from finely rib-knitted fabric of 100% cotton, is a pullover, ornamented by a ribbon applique at the center of the front of the round neckline. A textile loop is sewn onto the shoulder of each raglan, smocked, short sleeve, gathered at the edge.

This pullover can be worn underneath the second garment of style 50101/4, which is a one-piece sleeveless garment, manufactured from denim fabric of 100% cotton, characterized by short legs, metal buttons at each side below the waist, and adjustable suspenders, which extend from the upper back of the garment, through the textile loops on the shoulders of the pullover, to the metal fasteners at each corner of the top of the bib-front. Embroidery, pockets, and a false fly enhance the styling of this shortall.

The two garments of this style are being retained for reference purposes by the U.S. Customs Service.

The applicable subheading for the pullover will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for pulloversand similar articles, knitted, of cotton, other, other, other, girls’; and for the shortall will be 6204.62.2050, which provides for girls’bib and brace overalls, breeches and shorts, of cotton, other, bib and brace overalls, other, girls’, other. The duty rates will be 17.3 and 9 per cent ad valorem, respectively.

The pullover falls within textile category designation 339 and the shortall within 237. Based upon international textile trade agreements products of Bangladesh are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
