RE: The tariff classification of an electric lamp from China.

Dear Mr. Wei-Chung Liao:

In your letter dated January 11, 2002, on behalf of Cences, Inc., you requested a tariff classification ruling.

The subject merchandise, based on the information submitted, is known as the Nu-Way Gooseneck Light (item number SNU21). It consists of a metal shade, with top push-button switch, that has a socket, light bulb, and metal lamp cover. The shade is affixed to a flexible metal arm measuring about 21 inches in length by 2 ½ inches in diameter. This lamp, possessing no base, is designed to be fitted into the dedicated aperture of various popular sewing machines which power this merchandise. It is noted that the metal components are not of brass.

The applicable subheading for this electric lamp will be 9405.40.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for other electric lamps and lighting fittings of base metal, other than of brass. The rate of duty will be 6 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177.
