RE: The tariff classification of Le Wine from China

Dear Ms. Park:

In your letter dated January 18, 2002, you requested a tariff classification ruling.

The merchandise is Le Wine, a kit containing a wine bottle opener with a fitted base, a foil cutter, and a cheese knife. Also included is a replacement worm for the opener. To operate the opener, two clamps grasp the bottle, a lever is pulled toward the bottle to insert the worm into the cork, and then the lever is pulled back down to remove the cork. The base and the handle of the cheese knife are made of plastic. For tariff purposes, each component of the kit will be classified separately.

The applicable subheading for the wine bottle opener with stand and extra worm will be 8210.00.0000, Harmonized Tariff Schedule of the United States (HTS), which provides for hand-operated mechanical appliances, weighing 10 kg. or less, used in the preparation, conditioning or serving of food or drink, and base metal parts thereof. The rate of duty will be 3.7 percent ad valorem.

The applicable subheading for the cheese knife will be 8211.92.4060, Harmonized Tariff Schedule of the United States (HTS), which provides for knives with cutting blades, serrated or not, other than knives of heading 8208, and blades and other base metal parts thereof, with rubber or plastic handles, other, other. The rate of duty will be 1 cents each plus 4.6 percent ad valorem.

The applicable subheading for the foil cutter will be 8214.90.9000, Harmonized Tariff Schedule of the United States (HTS), which provides for other articles of cutlery, other, other. The rate of duty will be 1.4 cents each plus 3.2 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
