RE: The tariff classification of two women’s knit garments and two travel bags from Canada

Dear Mr. Thompson:

In your letter dated January 15, 2002, on behalf of Mondetta Clothing, Inc., 1109 Winnipeg Avenue, Winnipeg, MB R3E 0S2, you requested a tariff classification ruling.

You submitted a sample that comprises two women’s 100% cotton, knit pullovers that are packaged in two travel bags. The travel bags are made from Polyvinyl Chloride (PVC) sheeting and are designed to contain personal effects during travel. The large bag has a snap closure, while the small bag has a zipper closure. The large bag houses the sweatshirt and the pullover which is contained in the small bag.

Style EA0400 is a pullover that is made from a knit fabric that is brushed on the outside and features the following: a crew neckline, long sleeves with ribbed cuffs, and a ribbed bottom. The outer surface of the pullover measures more than 9 stitches per 2 centimeters in the horizontal direction. An “earls” logo is sewn in the chest area.

Style EA0600 is a pullover that features a crew neckline, short hemmed sleeves, and a hemmed bottom. An “earls” logo is embroidered on the left chest.

Your samples are being returned.

The applicable subheading for each pullover will be 6110.20.2075, Harmonized Tariff Schedule of the United States (HTS), which provides for sweatersand similar articles, knitted: of cotton: otherother: women’s. The general rate of duty will be 17.3% ad valorem.

The HTS subheading for each travel bag will be 4202.92.4500, which provides for travel, sports and similar bags, with outer surface of sheeting of plastic, other. The general rate of duty will be 20% ad valorem.

Based upon international textile trade agreements products of Canada are not subject to quota nor the requirement of a visa.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
