RE: The tariff classification of three women’s knit sweaters and two knit jackets from China.

Dear Mr. Meyer:

In your letter dated January 14, 2002, you requested a classification ruling on behalf of DZ Trading LTD, Los Angeles CA. As requested, your samples are being returned to you.

Your sample, style W21, is a woman’s sweater constructed from 100% wool knit fabric. The outer surface of the garment measures less than nine stitches per two centimeters in the horizontal direction. The sweater features a mock collar, partial zipper opening, long sleeves and an embroidered design at the neck, chest, sleeves and bottom. The neck, sleeves and bottom are finished with a rolled edge.

Style J30 is a woman’s sleeveless sweater constructed from 100% brushed wool fabric. The outer surface of the garment measures less than nine stitches per two centimeters in the horizontal direction. The sweater features a mock collar, a full front opening with six metal toggle closures, and an embroidered design at the neck, armholes, and bottom. The neck, armholes, placket, and bottom are finished with knit capping.

Style J29 is a woman’s jacket constructed from 100% brushed wool knit fabric. A part of the sleeves are made from jersey knit fabric. The jacket features a mock collar, a full front opening with a zipper closure, a woven lining, two front zippered pockets, two side slits, and embroidered designs at the neck, placket, sleeves, and pocket area. The collar, placket, sleeves, and bottom are finished with knit capping.

Style W12 is a woman’s sweater constructed from 100% wool knit fabric. The outer surface of the garment measures less than nine stitches per two centimeters in the horizontal direction. The sweater features a mock collar, a full front opening with a zipper closure, a woven lining, and embroidered designs on the chest, sleeves and back panel. The neck, sleeves, and bottom are finished with a rolled edge.

Style J25 is a woman’s jacket constructed from 100% brushed wool knit fabric. The sweater features a mock collar, a full front opening with a hidden placket zipper closure and three nonfunctional buttons, long sleeves with turn up cuffs, a lightweight woven lining, two front flap pockets with nonfunctional buttons, a hemmed bottom and two side slits. The neck sleeves, placket, and slits are finished with knit capping.

The applicable subheading for the three women’s sweaters will be 6110.11.0030 Harmonized Tariff Schedule of the United States (HTS), which provides for sweaters, pullovers, sweatshirts, waistcoats (vests) and similar articles, knitted or crocheted: of wool or fine animal hair: of wool: sweaters: women’s. The applicable duty rate will be 16.2% ad valorem.

The applicable subheading for the two women’s jackets will be 6102.10.0000 Harmonized Tariff Schedule of the United States (HTS), which provides for women’s or girls overcoats, carcoats, capes, cloaks, anoraks, windbreakers, and similar articles, knitted or crocheted, other than those of heading 6104: of wool or fine animal hair. The applicable duty rate will be 58.4 cents/kg + 17.1% ad valorem.

The sweaters fall within textile category designation 446. The jackets fall within textile category designation 435. Based upon international textile trade agreements products of Taiwan are subject to quota and the requirement of a visa.

The designated textile and apparel categories and their quota and visa status are the result of international agreements that are subject to frequent renegotiations and changes. To obtain the most current information, we suggest that you check, close to the time of shipment, the U.S. Customs Service Textile Status Report, an internal issuance of the U.S. Customs Service, which is available at the Customs Web site at www.customs.gov. In addition, the designated textile and apparel categories may be subdivided into parts. If so, visa and quota requirements applicable to the subject merchandise may be affected and should also be verified at the time of shipment.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
