RE: The tariff classification of a hula skirt, flower lei and flower bracelet from China

Dear Ms. Wong:

In your letter dated December 28, 2001, received in this office January 8, 2002, you requested a classification ruling.

The first item is a Hula Skirt made of polystyrene and polyester. The polystyrene strip is 10mm in width and therefore is not considered a textile.

The second item, called Hawaiian Lei, is polyester flowers strung on a plastic thread with plastic cylinder spacers.

The final item, called Flower Twister, is made exactly like the lei, but is shorter and is worn like a bracelet.

The applicable subheading for the Hula Skirt will be 9505.90.6000, Harmonized Tariff Schedule of the United States (HTS), which provides for Festive, carnival or other entertainment articles,: Other: Other. The duty rate will be free.

The applicable subheading for the Hawaiian Lei and the Flower Twister will be 6702.90.3500, Harmonized Tariff Schedule of the United States (HTS), which provides for Artificial flowers, foliage, fruit and parts thereof; articles made of artificial flowers, foliage or fruit, or other materials, other, of man-made fibers. The rate of duty will be 9 percent ad valorem.

This ruling is being issued under the provisions of Part 177 of the Customs Regulations (19 C.F.R. 177).
